Terms & Conditions
Please read these terms carefully before booking Heyy Banarasi Studio. By paying a booking advance, you agree to all terms below.

These Terms & Conditions ("Terms") govern all photography, videography, films, editing and related services ("Services") provided by Heyy Banarasi Studio, Banaras(Varanasi), Uttar Pradesh, India ("Studio", "we", "us") to any client ("Client", "you"). By booking, paying an advance, or signing a quotation/invoice, you accept these Terms in full.
1. Booking & Advance
- A booking is confirmed only after payment of the agreed advance/retainer. Dates are held on a first-paid, first-served basis.
- The advance/retainer is strictly non-refundable. It compensates the Studio for blocking the date, declining other work, and pre-production effort.
- Quoted prices are valid for 15 days unless stated otherwise and exclude travel, stay and applicable taxes.
2. Payment Terms & Non-Payment
- Unless agreed in writing, payment is: advance on booking, a further instalment on the shoot day, and the balance in full before final delivery.
- Final photos, films and raw/edited files are released only after 100% payment is received. Watermarked previews may be shared in the interim.
- If any payment is delayed beyond its due date, the Studio may pause editing, withhold delivery, and charge late interest of 2% per month on the outstanding amount until paid.
- The Client shall not withhold, deduct, reduce or "stop" payment on grounds of subjective creative preference, third-party opinions, or reasons outside the agreed scope. Delivered work is deemed accepted if no written, specific objection is raised within 7 days.
- No chargebacks. As Services are bespoke and time-blocked, the Client agrees not to initiate payment reversals or chargebacks. Any such attempt is a breach of these Terms, and the Client remains liable for the full amount plus recovery costs.
3. Cancellation & Rescheduling
- Cancellation by the Client at any time forfeits the advance/retainer.
- Cancellation within 15 days of the event additionally makes 50% of the total package payable.
- One reschedule is permitted subject to availability if requested at least 15 days prior; new dates may carry revised pricing.
- If the Studio must cancel due to reasons within its control, paid amounts for undelivered Services are refunded — this is the Client's sole remedy.
4. Deliverables & Timelines
- Delivery timelines are estimates and begin from the date of full payment and receipt of all required inputs from the Client.
- The number of edited photos/films, formats and revisions are as per the agreed package. Additional edits are chargeable.
- The Studio retains backups for up to 90 days after delivery; thereafter the Client is responsible for storage.
5. Creative Licence
- The Client engages the Studio for its distinctive style. Editing, colour grading, song selection and creative choices are at the Studio's artistic discretion. Personal style preferences are not grounds for non-payment.
- The Studio is not liable for limitations caused by weather, venue restrictions, lighting, guest conduct, or events outside its control.
6. Copyright & Usage Rights
- The Studio owns the copyright in all images and films it creates. The Client receives a personal, non-commercial licence to use delivered work.
- The Studio may use delivered work in its portfolio, website and social media for promotion, unless the Client opts out in writing before the shoot.
- Reselling, commercial use, or editing/re-grading the Studio's work without written consent is prohibited.
7. Client Responsibilities
- Provide accurate event details, timely access, permissions and a safe working environment for the team and equipment.
- Obtain all required venue/third-party permissions. The Client indemnifies the Studio against claims arising from missing permissions.
8. Limitation of Liability
To the maximum extent permitted by law, the Studio's total liability for any claim is limited to the amount actually paid by the Client for the specific Service in question. The Studio is not liable for indirect, incidental or consequential losses. Equipment failure, data loss, or force majeure (acts of God, government action, illness, accidents, network/power failure) are excluded.
9. Dispute Resolution & Governing Law
- These Terms are governed by the laws of India.
- The parties shall first attempt to resolve any dispute amicably in good faith.
- Failing that, disputes shall be referred to arbitration by a sole arbitratorunder the Arbitration and Conciliation Act, 1996, seated in Varanasi, Uttar Pradesh, conducted in English.
- Subject to arbitration, the courts at Varanasi, Uttar Pradesh shall have exclusive jurisdiction.
10. Changes
